Who we are
Shayan the Trainer is a personal training business operated by Shayan as a sole proprietorship in Vancouver, British Columbia, Canada. Shayan operates this website and is the person responsible for the personal information described in this policy.
You can reach us by email at hello@shayanthetrainer.com. We train clients in person in North Vancouver, West Vancouver and Downtown Vancouver and online anywhere.
We handle personal information in line with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia's Personal Information Protection Act (PIPA), as they apply to us.
Information we collect
We collect only what we need to answer your enquiry and to keep the website working well. We do not buy personal information from data brokers and we do not sell yours.
Please do not send detailed medical information through the website form. If an injury or health condition is relevant to your training, we will discuss it with you directly during your consultation.
- Information you give us — when you submit the consultation form: your first and last name, email address, phone number (optional), and anything else you choose to include in your message.
- Information collected automatically — when you browse the site, our hosting provider's servers record standard technical information such as your IP address, browser and device type, the pages requested, and the date and time of the request. This is used to deliver the site and keep it secure.
Why we use it, and our legal basis
We use the information above to respond to your consultation request, to recommend and arrange training or coaching, to provide and improve the website, to keep it secure and detect abuse, and to comply with our legal and tax obligations.
By submitting the form you consent to us using your information for these purposes. You can withdraw that consent at any time by emailing us, subject to any legal or contractual restrictions. Where a privacy law that requires a legal basis applies to you (for example the UK/EU GDPR), we rely on your consent, on the steps necessary to enter into a contract at your request, on our legitimate interest in running and securing our website, and on our legal obligations for record-keeping.
We do not use your information to make decisions about you by automated means alone, and we do not profile you for automated decision-making.
Where your information is processed
Some of our service providers, including our form and email providers, store and process information on servers outside Canada, including in the United States. While it is there, it may be accessed by courts, law-enforcement and national-security authorities of that country under its laws. We use contracts and other measures with these providers so that your information receives a comparable level of protection.
How long we keep it
We keep consultation requests and enquiry details for 24 months from our last contact, unless you ask us to delete it sooner. If you become a client, records we must keep for tax or legal reasons are kept for as long as the law requires, and then securely deleted.
Your rights and choices
Whatever your location, you can ask us to give you a copy of the personal information we hold about you, correct it if it is wrong, delete it, or stop using it for a particular purpose. You can also ask us to stop sending you messages at any time.
Depending on where you live you may have additional rights — for example to data portability, to withdraw consent, to object to processing, to appeal a refused request, or to be free from discrimination for exercising a privacy right. We honour all of these regardless of where you live.
To exercise any right, email hello@shayanthetrainer.com. We will respond within the time your local law allows — and within 30 days in every case. We may need to verify your identity before acting, and we will only ask for what is necessary to do so. You may use an authorised agent where your local law allows it.
If you are unhappy with our response, you may complain to the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Privacy Commissioner of Canada.
Children
This website is intended for adults and is not directed at children. We do not knowingly collect personal information from anyone under 18 without a parent's or guardian's involvement. If you believe a child has given us their information, contact us and we will delete it.
How we protect it
The site is served over an encrypted HTTPS connection, and we limit access to enquiry details to the people who need it to reply to you. No method of transmission or storage is completely secure, so we cannot guarantee absolute security — but we will notify you and the relevant regulator, as required by law, if a breach affects your information.
Links to other sites
Our site may link to other websites, such as our Google Business Profile. We are not responsible for their privacy practices, and this policy does not apply to them. Read their policies before giving them your information.
Changes to this policy
We update this policy when our practices change. The date at the top shows when it was last revised. If a change materially affects how we use your information, we will make that clear on this page.
