These terms apply to your use of this website. By browsing the site or sending us an enquiry, you agree to them. If you do not agree, please do not use the site.

Who these terms are with

This website is operated by Shayan, a personal trainer carrying on business as Shayan the Trainer in Vancouver, British Columbia, Canada. "We", "us", and "our" mean Shayan the Trainer; "you" means the person using the site.

Using this website

You may use this site for your own lawful, personal purposes. You must be at least 18 years old to request training through it; anyone younger needs a parent or guardian to contact us on their behalf.

You agree not to:

  • use the site in any way that breaks the law or infringes someone else's rights;
  • attempt to gain unauthorised access to the site, its server, or any connected system;
  • introduce malware, or interfere with the site's normal operation;
  • scrape, harvest, or systematically copy content from the site for a commercial purpose without our written permission; or
  • submit false information, or someone else's personal information without their permission.

Our content

All text, images, logos, layouts, and other material on this site are owned by Shayan the Trainer or used with permission, and are protected by copyright and trade mark law. You may view, download, and print pages for your own reference. Any other use — copying, republishing, or adapting the material — needs our written permission.

Our name, logo, and brand marks may not be used without our written permission.

Accuracy of information

We work to keep the information on this site correct and current, but it is provided for general information only. Descriptions, images, availability, and timelines may change, and small variations between what is shown and what is supplied can occur.

Exercise and nutrition information on this site, including our blog, is general information only. It is not medical advice, a diagnosis, physiotherapy, or a treatment plan, and it is not a substitute for advice from your physician, physiotherapist or registered dietitian.

Corrective exercise and movement sessions support exercise and physical conditioning. They are not a substitute for medical treatment, physiotherapy, or diagnosis. If you have pain, an injury, a medical condition, or are pregnant, speak to a qualified health professional before starting any exercise or nutrition program.

Results vary from person to person and depend on many factors, including consistency, sleep, nutrition and health. Testimonials describe individual experiences and are not a promise of the same outcome.

Enquiries and contracts

Nothing on this website is a binding offer. Session prices, packages, locations and availability shown here are indicative and may change.

Submitting the consultation form is an enquiry — it does not create a contract or book a session. A training or coaching arrangement is formed only when we both agree specific terms in writing, including price, schedule, location and any cancellation policy. Those terms govern your training, and where they conflict with these terms, they take priority.

Before training starts, we may ask you to complete a health and readiness questionnaire and a client agreement.

Availability of the site

We aim to keep the site available, but we do not guarantee uninterrupted access. We may change, suspend, or withdraw any part of the site at any time, and we may restrict access for maintenance or for security reasons without notice.

Third-party links and services

The site links to third-party services such as our form provider and Google. We do not control them, we do not endorse them by linking to them, and we are not responsible for their content, availability, or terms. Your use of a third-party service is governed by that provider's own terms.

Our liability

The website is provided on an "as is" and "as available" basis. To the fullest extent the law allows, we exclude implied warranties about the site, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data, or goodwill, arising from your use of this website. Where liability cannot be excluded, it is limited to the amount you have paid us, if any, in the twelve months before the claim.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — including the statutory consumer rights you have where you live, which these terms do not affect.

Your responsibility

If your misuse of this site, or your breach of these terms, causes us a loss or a claim from someone else, you agree to cover our reasonable costs in dealing with it.

Privacy

Our Privacy Policy explains how we handle personal information, and forms part of these terms.

Changes to these terms

We may update these terms. The version on this page at the time you use the site is the one that applies, and the date at the top shows when it was last revised. Continued use after a change means you accept the updated terms.

Governing law and disputes

These terms are governed by the laws of British Columbia, Canada, and any dispute will be dealt with by the courts of British Columbia sitting in Vancouver — except that, if you are a consumer, you keep the right to bring a claim in the courts of the country where you live, and the mandatory consumer-protection laws of that country still apply to you.

Before starting a formal dispute, please contact us — most issues are resolved with a conversation.

General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. These terms, together with any written agreement between us, are the whole agreement between us about your use of this site.
